A Nairobi court has directed the investigating officer to record the statements of President Uhuru Kenyatta and former PM Raila Odinga within seven days.
The two are listed as complainants in a case where two suspects; Rading Ambogo and Magoma Ayonga, were charged with the offense of unauthorized interception of computer data contrary to section 17(1) of the Computer Misuse and Cyber Crime Act.
Through lawyer Danstan Omari, the court was told that one of the accused person is apprehensive and psychologically traumatized and fears for her safety.
“We had requested statements from the complainant who is the President of this country and Raila Odinga who were alleged to have been in the entourage,…to date those statements have not come,”court was told.
The defense lawyer also requested that they be supplied with the original clip that captured the entourage on the said day.
The case will be mentioned on 9th of July.
The suspects are accused of intercepting Security CCTV footage capturing the Head of State’s entourage on June 2 at around 8pm on Kenyatta Avenue.
“This alleged offence of intercepting a security CCTV does not exist in law. Our clients were never in State House and have never gone to any government installation to capture CCTV footage of government,” said the lawyer.
According to the lawyer, the two accused persons are “mere casuals” at a hotel in the city.
The said CCTV footage captured President Kenyatta and ODM leader Raila Odinga inspecting development works being conducted in the City centre by the newly formed Nairobi Metropolitan Services (NMS).
